Triple Talaq: All You Need to Know About Controversial Muslim Divorce
The All India Muslim Personal Law Board (AIMPLB) recently met in Lucknow on the issue of triple talaq. With the case coming up in the Supreme Court on May 11, the meeting was historic for many reasons.
Let me give you the good news first. The AIMPLB issued a few directives: The big one was on the ‘boycott’ of those who misuse triple talaq. Others included strengthening of its women’s cell and helpline, using social media to educate people on the Sharia and declaring nikah halala anti-Sharia. Now the not-so-good one: The AIMPLB said triple talaq via WhatsApp is valid. Triple talaq, whether it is via phone or Whats App is unfair: Recently, a national level netball player Shumayala Javed’s husband gave her triple talaq over the phone in Amroha, Uttar Pradesh, after she gave birth to a girl child.
Instant Talaq is something which has its genesis is women being divorced through SMS or over a mere phone call. This instant talaq is essentially ‘Talaq-e-Biddah’. ‘Biddah’ means innovation and essentially all Muslims are advised against introducing ‘biddahs’ in their religion. This practice of talaq was first promoted by Caliph Umar, and is staunchly opposed by all the petitioners who have approached the Supreme Court for a reform in the case of triple talaq.
After the third talaq, a woman is supposed to marry another man, consummate the relationship, and only after following the original procedure of Talaq-e-Sunnah, will she be able to marry the former husband again. This practise is known as the ‘Nikah Halala’, and many Muslim women have condemned this practice as barbaric and it assumes more importance, in case the talaq is given as Talaq-e-Biddah.
However, the All India Muslim Personal Board (AIMPLB) urged the SC "not to meddle with its personal laws" as the issues fell outside the realm of judiciary.

ReplyDeleteAfter 32-year long battle, justice denied to Shah Bano will now be delivered to Shayara Bano — the two iconic victims of triple talaq. The instant divorce system, practiced predominantly by Sunni Muslim men, was declared unconstitutional by the Supreme Court in a landmark verdict on Tuesday. With this, India has now joined the list of 19 countries that have already banned the practice.
