Aarushi Talwar murder: Parents Rajesh and Nupur cleared on appeal
The Allahabad High Court on Thursday acquitted Rajesh Talwar and Nupur Talwar in the murder case of their daughter Aarushi Talwar and domestic help Hemraj. The High Court has, thereby, reversed the order of the CBI court that had convicted Aarushi’s parents in 2013. The two had been lodged in Dasna jail since 2013. Reports say that Rajesh and Nupur Talwar will walk out of the jail once the copy of the order reaches prison authorities. Rajesh and Nupur Talwar watched the Aarushi murder case verdict from a TV placed in their barrack. (Twitter reactions on the Allahabad High Court verdict) The Allahabad court verdict was supposed to come out at 2 PM but was postponed till 2:45 PM. The division bench comprising Justices BK Narayana and AK Mishra agreed to discrepancies in the CBI investigation. It has set aside the CBI court order convicting the Talwar couple and sentencing them to life imprisonment.
Allowing the appeal by the Talwars, the Allahabad High Court was of the view that as per circumstances and evidence on record, they can’t be held guilty.
The CBi said that it was waiting for the copy of the judgement. “We will decide our next course of action after studying the verdict,” said the investigative agency.
On the other hand, Naresh Yadav, the lawyer of Rajkumar and Krishna, the two others who were set free by the CBI court, said that he will move Supreme Court against the order. He said that this was a fight for the poor and they will certainly move the apex court against the Allahabad High Court verdict.
The Talwar couple – Nupur and Rajesh Talwar – had challenged a CBI court’s order convicting them for the murder of their daughter Aarushi and domestic help Hemraj in 2008. The Talwar couple were awarded life imprisonment by a CBI court on November 26, 2013, a day after their conviction. Justices BK Narayana and AK Mishra had reserved its judgment on the appeal for October 12.
The Talwar couple has been lodged in Dasna Jail, Ghaziabad since their sentencing. A source from Dasna jail told CNN News18 that the couple didn’t have breakfast since morning. Four days ago, Rajesh Talwar’s brother had come over to meet the Talwars at the Dasna Jail.
14-year-old Aarushi Talwar was found murdered with her throat slit at her residence in Noida’s Jal Vayu Vihar. The police had initially suspected Talwars’ domestic help Hemraj, who had gone missing, but found him dead on their terrace, a day later. While Aarushi Talwar’s postmortem report ruled out sexual assault, the Police said that the double murder was committed with “surgical precision”.
A few days later, the Delhi Police joined the murder probe and said that murder committed by “a doctor or a butcher”. On May 22, 2008, Nupur and Rajesh Talwar came under suspicion and the probe for “honour killing” was started. Police had also questioned Aarushi’s friend whom she spoke to 688 times in the last 45 days before her murder. A day later, Rajesh Talwar was arrested.
